The protection of key intellectual property has become a vital part of companies’ business strategies and an increasingly difficult challenge in the high tech world of global commerce. We focus closely with our clients on developing, implementing and enforcing mechanisms for the protection of their intangible assets. We assist clients in achieving protection of patents, trademarks, copyright and other IP through registration in the United States and in other countries around the world. We also counsel clients in a range of industrial sectors in the protection of trade secrets including in countries where these are not recognized as a specific form of intellectual property. We develop strategies for clients to protect their IP assets in commercial transactions and to extract value from that property in licensing transactions. We also counsel and represent our clients in enforcing their internal procedures against unauthorized use of IP assets and in identifying and taking measures against misappropriation of trade secrets and other intellectual property. At the policy level, our lawyers have been involved in multilateral efforts to extend IP protection worldwide including through the adoption of meaningful new undertakings in recent U.S. free trade agreements.

Protection of intellectual property is critical both in commercial transactions and in sales of products and services to the U.S. Government. Our lawyers have deep experience in counselling clients on the requirements of the Federal Acquisition Regulation (FAR) and the supplemental procurement regulations of the Defense, Energy and other Departments. We counsel clients on the implications of the various regulations and contract clauses relating to rights in intellectual property used and created during performance of U.S. government contracts. Our clients include many of the leading technology companies, institutions and organizations doing business with the U.S. government.
